1. Introduction & Acceptance

Welcome to Parametricut. By accessing or using our website at www.parametricut.com, purchasing any of our digital design files, or subscribing to any of our plans, you agree to be bound by these Terms and Conditions. Please read them carefully before making any purchase.

These Terms constitute a legally binding agreement between you ("Customer", "User", "you") and Parametricut ("we", "us", "our"), a business entity operating under the laws of India.

If you do not agree to these Terms, please do not use our website or purchase our products.

2. Products & Services

Parametricut offers the following digital products and services:

•       Single Design Files — Individual SVG, DXF, AI, or other digital design files for use with laser cutters and CNC machines.

•       Design Bundles — Curated collections of multiple design files offered at a discounted price.

•       Subscription Plans — Recurring monthly or annual plans that provide access to a library of design files and/or new releases.

All products sold on our platform are digital in nature. No physical goods are shipped.

3. Digital Product License

3.1 Personal & Commercial License

Upon successful purchase, you are granted a non-exclusive, non-transferable license to use the purchased design files subject to the following conditions:

•       You MAY use the files to create physical products for personal use or for sale (e.g., items made with a laser cutter or CNC machine).

•       You MAY use the files for commercial purposes, meaning you can sell finished physical goods made using our designs.

•       You MAY NOT resell, redistribute, share, sublicense, or give away the original digital design files themselves.

•       You MAY NOT upload our design files to any other marketplace, platform, or file-sharing service.

•       You MAY NOT claim ownership or copyright of our original design files.

3.2 Subscription License

Subscribers may access and use all designs available during their active subscription period. Upon cancellation or expiration of your subscription, you retain the right to use designs you accessed during your subscription but may not download new files.

4. Payments & Pricing

All prices are listed in USD (or INR where applicable) and are subject to change without prior notice. Prices do not include any applicable taxes, which will be calculated at checkout based on your location.

•       Single designs and bundles are one-time purchases.

•       Subscriptions are billed on a recurring basis (monthly or annually) depending on the plan selected.

•       We use secure third-party payment processors. We do not store your credit/debit card information.

•       All transactions are subject to the terms of the payment processor used.

5. Subscriptions & Cancellation

Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.

•       You may cancel your subscription at any time from your account dashboard.

•       Cancellation takes effect at the end of the current billing period. You will continue to have access until then.

•       We reserve the right to modify, suspend, or discontinue any subscription plan with reasonable prior notice.

6. Refund Policy

Due to the digital and instantly downloadable nature of our products, we generally do not offer refunds once a file has been downloaded or accessed. However:

•       If you experience a technical issue preventing download and our support team is unable to resolve it within 7 business days, you may be eligible for a refund.

•       If a file is significantly different from its description or preview, please contact us within 7 days of purchase.

•       Subscription refunds are handled on a case-by-case basis. No refunds are issued for partial subscription periods already used.

7. Intellectual Property

All design files, graphics, content, branding, and materials on Parametricut are the intellectual property of Parametricut or its licensors and are protected under applicable copyright, trademark, and intellectual property laws of India and international treaties.

Unauthorized reproduction, redistribution, or commercial exploitation of our intellectual property is strictly prohibited and may result in legal action.

8. User Accounts

To purchase or subscribe, you may be required to create an account. You are responsible for:

•       Maintaining the confidentiality of your login credentials.

•       All activities that occur under your account.

•       Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

9. Prohibited Use

You agree not to use our website or products to:

•       Violate any applicable laws or regulations.

•       Infringe upon any intellectual property rights.

•       Distribute malware, spam, or any harmful content.

•       Attempt to gain unauthorized access to our systems.

•       Engage in any activity that disrupts or interferes with our services.

10. Disclaimer of Warranties

Parametricut provides its products and services on an "as is" and "as available" basis without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that our files will be compatible with all software, machines, or equipment. It is your responsibility to verify compatibility before purchase.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Parametricut shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our products or services.

Our total liability shall not exceed the amount paid by you for the specific product or service in question.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Gujarat, India.

We encourage you to contact us first to resolve any disputes amicably before pursuing legal action.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to our website with an updated date. Your continued use of our website after any changes constitutes acceptance of the new Terms.
